Assessment First LLC (“Assessment First,” “we,” or other applicable first-person pronouns) provides services to organizations (our “customers”). This Privacy Notice and our Cookie Notice (“Notice”) explains how we collect, use, disclose, safeguard, transfer, access, dispose of, and otherwise process (collectively, “Process”) information regarding individuals who have a business relationship with us, such as agents of our customers, potential customers, and vendors, in our business interactions. It also covers visitors of our website (https://www.assessmentfirst.com/) (the “Site”) and individuals who engage with us on social media regardless of our business relationship with them.
Under applicable privacy laws, for most of the Personal Information Assessment First Processes, we do so on behalf of our customers. When acting in this capacity, generally, our customers’ privacy policies and procedures apply. We will handle information, including Personal Information, that we Process in this capacity based on the customer’s direction. If we are Processing your Personal Information because of your relationship with another organization, it is likely that this situation applies. We encourage you to read the privacy policies of those organizations and exercise any applicable rights by contacting them directly.
As such, this Privacy Notice does not apply to:

This Notice is effective as of the “Last Updated and Effective Date" above and will remain in effect except with respect to any provisions that are changed in the future. Assessment First may make changes to this Notice from time to time. Changes will be effective immediately upon their posting to the Site or upon you being otherwise notified. You are expected to check this page regularly so you are aware of any changes, as they are binding on you. Your continued interaction with us after we post a revised Notice means that you accept and agree to the changes.
Children’s Information
Assessment First does not direct its services to minors, and we do not knowingly collect Personal Information from minors. If you are under 13 (or the age of majority where you live), please do not visit the Site, engage with us on social media, use our services, or otherwise provide us any information. If we become aware that a minor has provided us with Personal Information without compliant consent under applicable law, we will take steps to comply with any applicable legal requirement related to such information.
Personal Information We Collect about You
For the purposes of this Notice, “Personal Information” is broadly defined to mean information that can identify an individual directly or indirectly through reasonably available information and includes the definitions of “personal information,” “personally identifiable information”, “personal data,” and other analogous terms under applicable data protection laws.
Assessment First collects several types of information, which may include Personal Information, from and about you, including information:

We have not collected Sensitive Personal Information about you in the last 12 months.

We Do Not Sell or Share Your Personal Information

For the purpose of this section of the Notice, Personal Information is sold when it is transferred or made available to a third party in exchange for money or other valuable consideration, and Personal Information is shared when it is provided to a third party for cross-context behavioral advertising.
Assessment First does not sell or share your Personal Information. In the preceding twelve months, we have not sold or shared any Personal Information of consumers.
Video Data
If you watch videos on the Site, our social media accounts, or otherwise provided by Assessment First, we collect and use video viewing data in order to provide you with personalized recommendations and other features. This data may include information about the videos you have watched, the time and date of viewing, and other similar information. We disclose this data to third parties, including service providers and social media networks.
Your Rights and Choices
Assessment First strives to provide you with choices regarding your Personal Information. We have created mechanisms to provide you with the following control over your information:

Shine the Light Law
California's "Shine the Light" law permits consumers that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Please note, we do not disclose your Personal Information to third parties for their direct marketing purposes.

Please note that you will need to verify your identity before we can fulfill your request. Your request must: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information or an authorized representative of that person; and (ii) describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. We will respond to your verifiable request within any prescribed timelines. In some jurisdictions, there may be limitations on how often a request relating to Personal Information may be submitted.
Appointing an Authorized Agent
You may designate an authorized agent to submit a request on your behalf, subject to proof of identity and written authorization as required under the applicable privacy law. As part of our verification process, we may request that the agent provide, as applicable, proof concerning his or her status as an authorized agent. Data Retention
Except as otherwise permitted or required by applicable law or regulation, Assessment First will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, as required to satisfy any legal, accounting, or reporting obligations, or as necessary to resolve disputes. To determine the appropriate retention period for Personal Information, we consider applicable legal requirements, the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we Process your Personal Information, and whether we can achieve those purposes through other means.
Data Security
Assessment First uses physical, electronic, and administrative safeguards designed to protect your Personal Information from loss, misuse, and unauthorized access, use, alteration, or disclosure.
We require service providers to maintain data protections consistent with the amount, nature, and sensitivity of the Personal Information they are Processing and best practices. We do not guarantee that our safeguards will always work.
The safety and security of your information also depends on you. We urge you to take care when providing information that is available to the public, such as reviews or on our social media pages.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to us. Any transmission of Personal Information is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures.
